Ag Chains Plus, Inc., (“ACP”) is committed to protecting the privacy and security of your personal information. This privacy policy (“Policy”) describes the personal information we may collect from you, how we may use it, how and to whom we may disclose it, how we secure it, and how you may access and control its use in regards to marketing and other communications. This Policy also provides other relevant privacy information and how and when we may update this Policy and how to contact us with questions or comments.


Personal Information
This policy applies to identifiable information that we directly associate with a specific person or entity (“Personal Information”) such as name, addresses, phone numbers, and emails. Personal Information does not include “anonymous”, “de-identifiable”, or “aggregate” information. None of which can be associated to a specific person or entity.

Collection of Personal Information
We collect Personal Information about you when you complete a web form or otherwise interact with us. Information we collect includes:

  • Information you provide. We collect personal information when you send us a comment, send us an email, send us a text, call or otherwise communicate with us. For example, we may collect personal contact, billing and credit information when you sign up for service. We may also collect personal information when you call or email our sales representatives, enter information on our website, or submit a job application and/or resume. If you provide Personal Information to us which is used in connection on a co-sponsored website, this Policy will apply to our use of the information and the co-sponsor’s policy will apply to how they use the information.

  • Information from other sources. We may also gather information about you from external sources. For example, we may receive credit information from third party source before extending credit, in connection with employment screening, and we may obtain updated address information from shippers or other vendors.

Use of Personal Information
We use Personal Information for a variety of business reasons such as completing transactions, billing for products and services, verifying your identity, responding to your request for assistance in finding resolutions, creating and improving products and services, suggest additional / different products and services, make internal business decisions regarding current and future products and service offerings, and protect your rights and properties. If you apply or submit an application or resume, we use Personal Information to communicate with you and evaluate your qualifications for employment (subject to applicable law). We may contact you via email, postal mail, telephone, text, or other methods. You may opt out of receiving communications from us as outlined below in Opt-Out Option for Using Your Information

Disclosure of Personal Information
We do not rent, sell, or otherwise disclose your information to other nonaffiliated third party person or entity to market their products and services to you. We may disclose Personal Information to unaffiliated third parties when the following events occur:

  • With your consent. We may disclose your information to an unaffiliated third party with your consent. We may obtain your consent in various ways such as in writing, orally including voice mail, or when you consent is part of this Policy or implied as pursuant to which we provide you service. For example, if you purchase a product and request that it is shipped to a different location, you implicitly consent to disclose your name and address to a third party shipping vendor to complete the delivery.

  • To the primary account holder. We may disclose Personal Information to a primary account holder (financially responsible party of account). For example, a government agency obtains service for you, that entity is our customer, and we may provide Personal Information about you or your use of the services to them or others at their direction. When you are the primary account holder and you receive special or discounted pricing, terms, or other benefits through another party’s agreement with us, we may provide limited Personal Information to that party to verify your initial and continuing eligibility for the special benefits under their agreement with us.

  • Transaction Processing. We may disclose limited Personal Information to third parties that perform services on our behalf (for example, drop shipment order from manufacturer to you), and transactions on your behalf (for example, verification of your account information at your request to some third party business). We limit the disclosure of Personal Information to only the information needed for completing the transaction.

  • Business Transfers. We may disclose Personal Information as part of a corporate transaction such as a merger or acquisition, joint venture, corporate reorganization, financing, sale of company assets, or in the event of insolvency, bankruptcy, or receivership, in which Personal Information could be transferred to third parties as business assets in the transaction.

  • Legal Process and Protection of ACP and others. We may disclose Personal Information or communications where necessary to comply with a legal process (for example, court-ordered subpoena); to enforce or apply agreements; to initiate, render, bill, and collect for products and services; to protect our rights or property; in connection with claims, disputes, or litigation; to protect users of our products and services and our vendors from fraudulent, abusive, or unlawful use of such services; to facilitate our obligations due to a local, state, or federal governments; or if we determine disclosure is necessary.

Security of Personal Information
We use a variety of physical, electronic, and procedural safeguards to protect your Personal Information from unauthorized access, use, or disclosure while the Personal Information is under our control. For example, when you provide name and email information via our web-forms, we use encryption technology when transmitting that information. Although we cannot guarantee that loss, misuse, or alteration of your Personal Information will not occur, we strive to prevent such events.

We have developed practices and procedures to limit Personal Information access to those personnel with legitimate business needs. ACP employees are bound by our Code of Conduct, which obligates them to protect the confidentiality of your Personal Information. Violations subject employees to disciplinary actions, up to and including termination.

We retain Personal Information for as long as we have a business need, or as required by applicable laws, regulations, or as ordered by local, state or federal governments. When we dispose of Personal Information, we implement reasonable measures to erase or render the Personal Information unreadable (for example: shredding documents or wiping electronic media like hard drives, flash drives, or CD-ROMs). We will make reasonably attempts to notify you if we determine that a security breach involving your Personal Information has occurred, creates a risk of identity theft, or otherwise required by law.

Access to Your Personal Information
You may access and modify your contact information by sending us email at, or by calling our offices. Will make our best efforts to correct inaccurate information except where the request jeopardizes the privacy of others, or is unreasonable and impractical.

Opt-Out Option for Communications
We want to provide you with appropriate choices regarding our marketing communications and may choose to limit or opt-out of certain communication from ACP at any time. Although you may elect to not receive marketing communications from us, if you subscribe to our online services or buy products and services, you will continue to receive invoices, service and transactional notices, and similar communications.

  • If you are a registered subscriber to our blog page, you can log into your account and change your marketing preference on your profile.

  • You may also manage your marketing preferences by contacting us directly via phone or with respect to marketing email, by following the “unsubscribe” procedures attached to any marketing email we send you.

Not all marketing communications you receive on your mobile or portable device are sent or authorized by ACP. When you provide your mobile number other contact information to others, you may receive unwanted calls, text messages, or emails on your device. We take steps to reduce and eliminate unsolicited advertisements, but we cannot block all such advertisements or unsolicited communications.


Caller ID Blocking
When you use a mobile phone, land line or other communication device to call us, your name and number may transmitted and displayed on our phones LED screen. Refer to the specific instructions on your device regarding Caller ID Blocking. Caller ID Blocking does not prevent the display of your information when calling certain business numbers, including 911, 900 numbers, or toll-free numbers.

We do not solicit to children to purchase our products and services. Additionally, the no part of our website located at the URL (“Site”), which includes our events page and blog posts, is designed to attract children under the age of 13, and we have implemented strong measures to prevent us from intentionally or knowingly collecting Personal Information for anyone under the age of 18. Although the information on our web site does not contain adult oriented content, we do provide products and services that require a person to be old enough to enter into a binding contract. To this point, we encourage parents to be involved in the online activities (all devices that allow for internet browsing) of their children to ensure that no Personal Information is collected from your child without parental permission.

Cookies, Web Beacons and Similar Technologies
When accessing our Site, we may use cookies (small data text files placed on your computer or device) or similar technologies to identify the computer or device and record your preferences and other data so that our Site can personalize your visit(s). We may also use information collected from cookies to improve our Site, make recommendations, and complete transactions that you have requested. You may be able to set your browser(s) to reject cookies or delete cookies, but that may result in the loss of some functionality on our Site. We may also use Web beacons (small graphic images on a Web page or an HTML e-mail) to monitor interaction with our Site or email notifications. Web beacons are generally invisible because they are very small (only 1-by-1 pixel) and the same color as the background of the Web page or e-mail message. If we combine or link cookie or Web beacon information with Personal Information, we will treat the combined or linked information as Personal Information under this Policy. We may employ third-parties to place advertisements about our products and services on other websites. The use of cookies, Web beacons, or similar technologies by such third-party websites is subject to their privacy policies – not this Policy.

Customer Service Monitoring
We may monitor and record phone calls, e-mails, or other communications between you and our Customer Service representatives or other employees for training and quality assurance purposes and to review specific transaction requests.

We do not publish directories of our customers, nor will we provide or make Personal Information available to third-parties for listing in their public directories, without the customer’s prior consent.

Forums and Social Networks
If you use or link to a public forum, bulletin board, chat room, or social network on or from our Site, be aware that any personal information you submit can be read, collected, or used by other users of these forums, which includes sending you unsolicited messages. We are not responsible for access to or use of personal information you choose to submit or share with others.

Other Governing Terms
This Policy does not modify or alter any applicable agreement you have with ACP. For example, our Terms of Use (“TOU”) govern your access and use our Site. If this Policy conflicts with any portion of TOU, the TOU governs the extent of the inconsistency.

Third Party Advertisements
You may see third-party advertisements on our Site. These third-party advertisers, or their ad networks, may place or access cookies on your device that you use to access our Site and may collect certain anonymous information about your visit on our Site. The third-party advertisers who provide these ads may use this information to provide you with advertising on our Site. This advertising may be tailored to the interests the advertisers have inferred from your browsing of our Site or other websites with which the third-party is affiliated as an ad server or ad network. We do not provide Personal Information about you directly to the advertiser. We may, however, provide third-party advertisers with anonymous demographic or similar non-identifiable, aggregated data (unrelated to your browsing activities) that does not personally identify you. This data may be used by them to help tailor their ads on our Site.

Third-party advertisers or ad networks operating on our Site are required to participate in the opt-out process established by the Network Advertising Initiative (NAI). To learn more, or to opt-out of the automatic collection of information by these parties, please visit the NAI site. Please note that this opt-out is cookie-based. If you change computers, change Web browsers, or delete cookies, you will need to visit the NAI site and opt-out again. ACP does not have control over or access to any information contained in the cookies that are set on your computer by ad servers, ad networks, or third-party advertisers.

Electronic and Internet Communications Security
ACP cannot guarantee any communication conducted between you and us electronically via email, text or other web-based or wireless devices will be private or secure. Although it is illegal for unauthorized persons to intercept or access your communications or information, such interceptions or access can occur.


Changes to this Policy
We may update this policy if we change our practices, procedures or if legal or regulatory changes require it. If we decide to use or disclose personal information in a way that is materially different from that which was stated in this Policy at the time the Personal Information was collected, we will notify you by posting notice of the change on our Site for at least 30 days before we implement that change and will give you an opportunity to opt-out of the proposed use or disclosure of previously collected personal information. You should refer to this Policy often for the latest information and the effective date of any changes.
